General Terms and Conditions

1. Scope of Application

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership that, when entering into a legal transaction, acts in the exercise of its commercial or self-employed professional activity.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with ScaleART OHG.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3. Contract Language, Storage of Contract Text

The language(s) available for concluding the contract: German, English

We save the contract text and send you the order data and our General Terms and Conditions in text form. You can view the contract text in our customer login.

4. Delivery Conditions

In addition to the stated product prices, shipping costs may apply. You can find more detailed information about any shipping costs in the offers.

You generally have the option of collecting your order from ScaleART OHG, Schillerstraße 5, 67165 Waldsee, Germany during the following business hours: Mon - Fri from 8 AM - 12 PM and 2 PM - 4 PM

5. Payment

The following payment methods are generally available in our shop:

Prepayment

If you choose the prepayment method, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.

Cash on Delivery

You pay the purchase price directly to the delivery person. An additional fee of 7.50 Euro will be charged.

PayPal

During the order process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After submitting the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is then automatically carried out by PayPal immediately. You will receive further instructions during the order process.

PayPal Plus

Within the scope of the PayPal Plus payment service, we offer you various payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the PayPal payment method, you must be registered there or register first and legitimize yourself with your access data to pay the invoice amount. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment instruction. You will receive further instructions during the order process.

Credit Card via PayPal

If you have chosen the credit card payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your legitimation as the rightful cardholder by your credit card company at the request of PayPal, and your card will be debited. You will receive further instructions during the order process.

Direct Debit via PayPal

If you have chosen the direct debit payment method, you do not need to be registered with PayPal to pay the invoice amount. By confirming the payment instruction, you issue a direct debit mandate to PayPal. You will be informed by PayPal about the date of the account debit (so-called pre-notification). By submitting the direct debit mandate immediately after confirming the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited. You will receive further instructions during the order process.

Invoice via PayPal

If you have chosen the invoice payment method, you do not need to be registered with PayPal to pay the invoice amount. After a successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only make payments to PayPal with debt-discharging effect. For payment processing via PayPal, the terms and conditions and privacy policy of PayPal apply in addition to our GTC. Cash Payment upon Collection

You pay the invoice amount in cash upon collection.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance company.

8. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies.

For used goods: if the defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

The aforementioned restrictions and shortening of deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents:

  • in case of injury to life, limb, or health
  • in case of intentional or grossly negligent breach of duty as well as malice
  • in case of breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the scope of a guarantee promise, if agreed, or
  • insofar as the scope of the Product Liability Act is applicable.

9. Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents:

  • in case of injury to life, limb, or health
  • in case of intentional or grossly negligent breach of duty
  • in case of guarantee promises, if agreed, or
  • insofar as the scope of the Product Liability Act is applicable.

In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage typical for the contract at the time of conclusion of the contract.

Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are willing to participate in an out-of-court conciliation procedure before a consumer arbitration board.

11. Note according to the Battery Act

Since our shipments may contain batteries and accumulators, we are obliged by the Battery Act (BattG) to inform you of the following: Batteries and accumulators must not be disposed of in household waste, and you are legally obliged to return used batteries and accumulators. Old batteries can contain harmful substances that can damage the environment or your health if not stored or disposed of properly. However, batteries also contain important raw materials such as iron, zinc, manganese, or nickel and can be recycled. You can either return the batteries to us after use or return them free of charge in your immediate vicinity (e.g., in retail stores or at municipal collection points or in our shipping warehouse).

The return to sales points is limited to the usual quantities for end-users as well as those old batteries that the distributor carries or has carried as new batteries in its product range.

The symbol with the crossed-out waste bin means that you must not dispose of batteries and accumulators in household waste. Below this symbol, you will also find the following symbols with the following meaning:

  • Pb: Battery contains lead
  • Cd: Battery contains cadmium
  • Hg: Battery contains mercury
